Terms of Service

Last updated October 21, 2026

The short version

  • The Same-Day Website costs $1,500, paid before we start (or, where we offer it, 3 monthly payments of $550).
  • You book a launch day. We build your website that day, and it’s live on our web address by 5pm.
  • Website Care is $49 a month, charged from checkout, month to month. It keeps your website online and looked after. Cancel anytime; it ends at the end of the month you’ve paid for.
  • Until your launch day starts, the build fee is fully refundable. After that, it isn’t.
  • Your content and your domain are yours. The site’s design and code are ours, and you use them while Website Care is active.

This summary is for convenience. The full terms below are what apply.

1. About these terms

These Terms of Service (“Terms”) are an agreement between you and Delivery Operator Technologies LLC, doing business as Amplify Web Design (“Amplify”, “we”, “us”). They apply to the website design, build, launch, hosting and care services we provide, our website at amplifywebdesign.com, and the client portal at app.amplifywebdesign.com (together, the “Services”).

If you sign up on behalf of a business, you agree to these Terms for that business, and “you” means the business. By paying for the Services, using the client portal, or otherwise using the Services, you agree to these Terms. If you don’t agree, don’t use the Services.

The Services are offered to businesses located in the United States. You must be at least 18 years old to use them.

2. The Same-Day Website

For a one-time build fee, we design, build and launch a website for your business. It includes:

  • up to 5 pages, designed for your business;
  • a mobile-friendly design and a contact form that sends enquiries to your client portal;
  • one round of revisions on your launch day, after we send you the first version; and
  • launch on a web address we control (for example, yourbusiness.sites.amplifywebdesign.com), then connection to your own domain once you give us access (section 11).

We build from the information and materials you give us in our intake form. If something is missing, such as photos or text, we’ll write or create it for you. A revision round is one set of changes to the first version we send you; new pages, new features and redesigns aren’t revisions, and we’ll quote them separately. After launch, small edits are part of Website Care (section 6). No build work begins before payment.

3. Paying for the build

  • One payment. The build fee is $1,500, charged at checkout.
  • Payment plan. Where we offer it, you can instead pay 3 monthly payments of $550 ($1,650 in total). The first is charged at checkout and the other two monthly after that, and the plan ends automatically after the third. All 3 payments are owed, even if you cancel Website Care or stop using the Services before the plan ends.
  • Payments are processed by our payment processor, Stripe. We don’t store your full card number. Prices are in US dollars and don’t include any taxes that may apply.

4. Your launch day

After you pay, you book a launch day: a weekday from the open days we show you. On that day (all times are US Eastern):

  • Before the day. Send your intake form by 5pm on the business day before your launch day. Anything you don’t have, we’ll write or create.
  • The kickoff. We start with a short kickoff call in the morning.
  • Being reachable. Please stay reachable during the day and reply to our questions within one hour. If we don’t hear back within an hour, we’ll make our best judgment and keep going, so your launch isn’t held up.
  • The first version and revisions. We send you the first version in the early afternoon, and make your one round of revisions that afternoon.
  • Live by 5pm. Your website is published and reachable at the web address we give you on our domain by 5pm. Connecting your own domain isn’t part of the launch day: we connect it as soon as you give us access (section 11).

If something holds us up. If something outside our reasonable control delays us, such as an outage at our hosting provider, we’ll tell you and finish as soon as we can. If you ask on the day for more than we agreed, such as extra pages, we’ll quote it separately and schedule it.

Rescheduling. You can move your launch day once, free, if you ask at least 24 hours before it starts. Later changes, or a second reschedule, are at our discretion.

5. Refunds for the build

Until your launch day starts (section 4), you can cancel and we’ll refund your build payment in full (on the payment plan, we refund what you’ve paid and cancel the remaining payments). Once your launch day has started, the build fee is non-refundable, except where the law requires otherwise.

6. Website Care

  • Price and renewal. Website Care costs $49 per month, or the price shown at checkout. The first month is charged at checkout, and it then renews automatically every month, charging the payment method on file, until you cancel.
  • What it includes. Hosting for your website with an SSL certificate (https), security updates, backups of your website’s files, reasonable small edits you request through your client portal (such as updating text, photos, opening hours and minor changes), and support from a real person through the portal or by email. Larger work, such as new pages, new features or a redesign, isn’t included; we’ll quote it separately and only do it with your approval. We handle requests in the order we receive them and aim to complete small edits promptly, but we don’t guarantee a turnaround time for them.
  • Your website stays online while Website Care is active. When Website Care ends, your website goes offline (section 10).
  • Cancelling. There is no minimum term. You can cancel at any time from the Billing page in your client portal, or by emailing us. Cancellation takes effect at the end of the month you’ve already paid for. Except where the law requires otherwise, we don’t give refunds or credits for partial months. Cancelling Website Care doesn’t cancel payment-plan payments that are still owed (section 3).
  • Price changes. We may change the price of Website Care. We’ll tell you at least 30 days before a new price applies to you, and you can cancel before it takes effect.

7. Failed payments

If a payment fails, whether for Website Care or the payment plan, we’ll retry it and let you know. If it is still unpaid 14 days after it first failed, we may take your website offline until the balance is paid. Amounts you owe remain owed.

8. Your content

You keep ownership of the content you give us, such as text, photos, logos, trademarks and business information (“Your Content”). You give us permission to use, copy, edit, format and display Your Content to build, host and maintain your website and to provide the Services.

You confirm that you have the rights to Your Content, that it is accurate, and that it doesn’t break any law or infringe anyone else’s rights. You are responsible for the claims your website makes about your business, including licenses, prices, offers and reviews. We may decline to publish, or remove, content we reasonably believe is unlawful, infringing or harmful.

9. Who owns the website

Apart from Your Content, we own the website we create for you, including its design, layout, code, templates and graphics, and any images we create or license for it. While Website Care is active, you have the right to use the website for your business.

Your website includes a small “Website by Amplify Web Design” link in its footer. If you’d rather not have it, ask and we’ll remove it.

10. When Website Care ends

Your website goes offline at the end of your last paid month. If you ask, we’ll send you a copy of Your Content. You can also ask to buy the website’s files, and we’ll quote a price on request.

11. Your domain name

You own your domain name (for example, yourbusiness.com). If you already have one, you can give us access to it at your registrar, or add the one DNS record we give you; we connect it as soon as we have that access. You are responsible for renewing a domain you registered yourself and for keeping control of your account with your registrar.

If you don’t have a domain, we’ll register one in your name, with the first year’s registration included. After the first year, you can renew it through us at cost or move it to your own registrar account. If Website Care ends, you keep your domain and can point it somewhere else.

12. Your client portal and leads

Your client portal lets you request changes, see your website’s status, manage billing, and see leads submitted through your website’s contact form. You are responsible for keeping your login details confidential, for the people you invite to your account, and for activity under your account. Tell us right away if you think someone has accessed your account without permission.

We store your leads on your behalf and use them only to provide the Services. You are responsible for how you use and respond to them, and for any legal obligations you have to the people who contact you.

13. Acceptable use

You agree not to use the Services, or ask us to publish anything on your website, that is illegal, fraudulent, deceptive, defamatory, or infringes anyone’s rights, or that contains malware or spam. We may suspend or take down a website that breaks this rule. Where we reasonably can, we’ll tell you first.

14. Availability and results

We host websites on reputable cloud infrastructure and work to keep them online, but we don’t guarantee that the Services or your website will be uninterrupted or error-free. We may carry out maintenance from time to time.

We follow good practice for search engines, but we can’t guarantee any search ranking, amount of traffic, number of leads, or business results.

15. Our portfolio

We will only show your website in our portfolio or marketing with your permission.

16. Suspension and termination

We may suspend or end the Services if you seriously or repeatedly break these Terms, or if your account is unpaid as described in section 7. We may also stop providing the Services to you for any reason by giving you at least 30 days’ notice. In that case, we’ll refund any amount you’ve prepaid for Website Care for the period after the Services end, and, if we haven’t launched your website yet, your build payments in full.

17. Disclaimer of warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Limitation on liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. TO THE FULLEST EXTENT PROVIDED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE TOTAL FEES YOU ACTUALLY PAID US FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS SECTION DOES NOT LIMIT ANY REFUND THESE TERMS PROMISE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

19. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (1) your violation of these Terms; (2) Your Content, including any claim that it infringes someone else’s rights; (3) your use of the leads and other information you receive through the Services; or (4) your violation of applicable laws and regulations.

20. Arbitration and governing law

Any dispute, claim, or controversy arising from or relating to these Terms or the Services, including disputes arising from or concerning their termination, enforcement, interpretation, violation, non-performance, legality, or invalidity, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined exclusively by final and binding arbitration under the Rules of Arbitration of the American Arbitration Association (“AAA”) applying Massachusetts law. The AAA Arbitration Rules applicable to the claim(s) are expressly incorporated herein by reference. Information on how to start arbitration can be found at www.adr.org. You agree that any such arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.

In the event that the right to arbitrate any dispute, claim, or controversy arising out of or relating to these Terms is rendered invalid or unenforceable, the dispute, claim, or controversy shall be subject to the exclusive jurisdiction of the state courts of Massachusetts and shall be governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts without giving effect to any choice or conflict of law provision or rule.

21. Limitation on time to file claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

22. Changes to these terms

We may update these Terms from time to time. If we make a change that materially affects your Website Care or payment plan, we’ll tell you by email or in your client portal at least 30 days before it applies to you, and you can cancel Website Care before then. Otherwise, changes take effect when we post them here, and the date at the top of this page shows when they were last updated.

23. Waiver, severability and entire agreement

No waiver by the Company of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms will continue in full force and effect.

These Terms, together with our Privacy Policy, are the entire agreement between you and Delivery Operator Technologies LLC about the Services. If you sign a separate written agreement with us, that agreement takes priority where the two conflict.
